Inspiring Philosophy: The Trinity in the Old Testament

Saint Peter instructs believers to “[a]lways be prepared to make a defense to any one who calls you to account for the hope that is in you, yet do it with gentleness and reverence’ (1 Peter 3:15). Over the course of its existence, the Church has called the process of explaining, arguing for, and/or answering questions about, the Christian Faith apologetics (see here). Apologetics is defined as the religious discipline of defending religious doctrines through systematic argumentation and discourse. Someone who engages in apologetics is an apologist.

Perhaps my favorite apologist on Youtube is Michael Jones who creates videos for the channel Inspiring Philosophy. I find his work engaging, his arguments sound, and the topics he covers broad and interesting. As a result, I have decided to post his videos here and, as I usually do for these sorts of things, I will keep a running list of links to prior videos with each post of a new video.

Appellate Court Says Injunction Against Church Picketer Was Too Broad

In Tenth Presbyterian Church v. Snyder, (PA Super, Oct. 18, 2021), a Pennsylvania state appellate court held that the trial court was justified in issuing a preliminary injunction against Phillip Snyder, an excommunicated member of the church, who picketed the church every Sunday. However the appellate court held that the preliminary injunction’s requirement that Snyder remain at least 5,000 feet from the church property was not narrowly enough tailored. The appellate court pointed out that Snyder had engaged in aggressive and agitated behavior that frightened Church members, and that he carried a concealed firearm. Nevertheless, it concluded:

[T]he trial court couched its preliminary injunction in the broadest terms to protect the interest of the Church and its members, disregarding Snyder’s constitutional right to protest the Church and its leadership. A five-thousand-foot restriction places Snyder well beyond the point at which his constitutional right to protest is utterly extinguished.  Put succinctly, the five-thousand-foot restriction is not “couched in the narrowest terms that will accomplish the pin-pointed objective permitted by constitutional mandate and the essential needs of public order.”

Templeton Project: Squeeze Out the Spiritual Life–A Dictum of Our Secular Culture

In America the spiritual life and the exercise of religion are being squeezed out by the sights and sounds around us.  Among these phenomena are:

  1.  Street and highway noise
  2.  Noise in the market place (e.g. blaring music in the stores)
  3.  Constant advertising, reaching especially into the home (telephone soliciting)
  4.  The media (though we have a lot of control over this one)
  5.  Maniacal  driving
  6.  Too many talkers, too few listeners (Yours truly has a tendency to talk too much and listen too little)
  7.  The constant political shouting contest
  8.  You pick one

We are social beings.  Silence can be too deep.  We must establish a via media, a course between extremes. In our own lives, we must find enough space in the noise to continue our pilgrimage to the Kingdom of God.  We differ in our need for company, but all of us must not neglect prayer, reflection, and meditation that nourishes our relationship to God.  Without this spiritual support, including time to hear the Word of God speak to us, we are at the mercy of a secular culture, pressing its own agenda.

Joe Arcieri Songs: Beyondddd!

Joe Arcieri is a friend of mine who I worked with for many years during my ten years working for Acme Markets.  Joe, when not stocking milk or saving lives as a nurse, is an excellent guitar player.  I have had the privilege, from time to time, of (badly) plunking my bass guitar with Joe as he melts a face or two with a great solo.

As great musicians do, Joe has written some of his own songs and keeps a soundcloud site to post them.  When I have opportunity, I will post his music here as well.

LONG LIVE THE POPE

Although I am not Catholic, I love the current Pope Francis. He is the first pontiff who hails from Argentina, and every few days he reveals a new tidbit about himself or makes a statement which does not generally involve religion that I tend to agree with. Recently came the announcement that he used to be a bouncer at a club. He definitely agrees with the common man, and he does not confine himself to statements considered politically correct.

                He made a statement recently that knocked my socks off. In his statement he disagreed with the trickle down economics theory which, boiled down to one sentence, states that when people do well in business or life, they will assist other people and the economy by hiring more people, etc. He stated that there is no guarantee that the wealthier people and institutions get, the more they will spread the wealth. In fact, that is not the case. The factors of excess, greed and narcissism must be considered, and when considering those factors, it is more natural for people who make more to want to keep more. Although I applaud the efforts of the likes of Warren Buffett and Bill and Belinda Gates to give away a majority of their wealth, these people are at the top of the one percenters, and couldn’t even begin to spend their money on themselves during their lifetimes.

                There are another group of people who I joke would coat themselves with gold if they could, just to indicate just how wealthy and successful they are. Many more people are like them. Look at lottery winners, about 70% of whom have lost or spent their money in a couple of years of winning. Other people give to charities or institutions for the purpose of having their name spread in a splashy manner on buildings and in the media.

                To relate the above thoughts to the law, I think of what I do on a regular basis. Although lawyers have certainly added to the complexities of life, we do good deeds, and perform a form of charity every day. Not all lawyers of course. And not all lawyers are in the type of practice where they can assist others. But, for lawyers who assist individuals, life has become quite complicated. I receive many calls daily from people who my need legal assistance, or may just not understand what they need to do to assist themselves. I am always astonished at the problems people have and how many medical and mental problems people must deal with, as well as financial issues. Although I cannot spend a lengthy amount of time with these callers, I can spend a few minutes to direct them to where they should go. Most of them a very grateful that someone is evening accepting their call, and are grateful beyond that if they are given some guidance. Although we are assaulted everyday through the media with ridiculous things, and with ridiculous people, and with people who have achieved fame for no conceivable reason, let us remember that the majority of the populace are average, are poor or lower middle class, do not have handlers, agents, assistants, trainers, nutritionists to guide them in their daily lives. They are waiting to achieve their glory in the kingdom of heaven. It is my pleasure to assist them in achieving a little heaven on earth by making their lives easier, and I have had that pleasure going on 40 years.  And, for those people who choose to be bitter, angry, see themselves as victims, see others as always trying to take advantage of them, let us pray for them, because they will not enjoy the pleasure of the advice of a good lawyer, namely me.     

2nd Circuit: Protesters’ Sidewalk Tables Were Not A “Place of Worship” Under FACEA

A provision (18 USC §248) in the Freedom of Access to Clinic Entrances Act of 1994 (“FACEA”) prohibits intentionally injuring, intimidating, or interfering with anyone who is exercising 1st Amendment religious freedom rights “at a place of religious worship.”  In Zhang Jingrong v. Chinese Anti-Cult World Alliance, Inc.(2nd Cir., Oct. 14, 2021), the U.S. Second Circuit Court of Appeals held that “a place of religious worship” in the statute is limited to “a place recognized or dedicated as one primarily used for religious worship”, and not merely any place where religion is practiced.  Applying this definition, the court concluded that five tables on the sidewalk in Flushing, Queens, New York where Falun Gong adherents passed out flyers and displayed posters were not a “place of religious worship.” The court said in part:

Plaintiffs and their fellow practitioners treated the tables primarily as a base for protesting and raising public awareness about the Chinese Communist Party’s alleged abuses against Falun Gong, rather than for religious worship. Nor was there evidence that the Falun Gong religious leadership had designated the tables as a place primarily to gather for or hold religious worship activities.

Judge Walker filed a concurring opinion arguing that 18 USC §248 exceeds Congress Commerce Clause power, saying in part:

In prohibiting violence against worshippers at places of religious worship, FACEA regulates local, non-economic conduct that has at best a tenuous connection to interstate commerce.
